Bankruptcy of cloud supplier

The first article on legal consequences of bankruptcy of cloud suppliers was published on 27 March 2012.

In other words what happens if a cloud supplier goes bankrupt? What are the risks your enterprise?

Marianne Korpershoek: "Before a company involves a cloud provider, it is important to first analyze which business processes are eligible for the cloud. Continuity must be well organized, both technically and legally."

Cloud escrow

The second article was published on 24 May 2012 and discussed the use of cloud escrow solutions to guarantee continuity and to prevent vendor lock-in.

With the popularity of IT and cloud solutions the dependence of the continuity of service by the supplier has increased considerably. Clever solutions are required to ensure continuity. The old familiar concept of escrow often needs to be restructured to meet legal requirements.

The level of measures to be chosen also depends on whether business-critical applications are concerned.

Marianne Korpershoek: "If a supplier goes bankrupt, an escrow arrangement can help. But in many cases these arrangements may prove worthless. In the application of cloud computing, the problems will only increase. Customers need more time to make good choices. In addition, it may be questionable whether a really good cloud escrow is afforable."
